Tyco Fire Products Water Contamination Class Action Settlement.
If you currently reside in or previously resided in or currently own or previously owned a property with a Private Well Drinking Water Source within Peshtigo, Wisconsin for at least one year between January 1, 1965 and December 31, 2020, you may be eligible for a cash payment and your rights may be affected by a proposed class action settlement.
Settlement Update
The Claims Administrator began issuing payments to Class Members with eligible Property Damages or Exposure claims on a rolling basis in May 2022. Denial letters have been sent to Claimants who do not qualify for payment. The Claims Administrator issued Supplemental Property Damage and Supplemental Exposure payments in December 2022.
Supplemental Property Damage and Supplemental Exposure payments were determined by the Settlement Administrator and made to Class Members who submitted documentation that showed any of the following: (1) residing in the Class Area eligible property for over 10 years, (2) past out of pocket payments for well water testing, (3) past medical examinations and/or out of pocket payments for medical bills related to chemical exposure in well water, (4) payments to obtain alternative water sources, and/or (5) the residential property value is 50% or more higher than the median home value in the Class Area. Please understand the Settlement Administrator is required by the Court to make sure only valid, documented claims receive appropriate settlement compensation.
How Do I Know if I’m Part of the Settlement?
Members of the class must fit the following description:
All persons who:
- During the period between January 1, 1965 and December 31, 2020,
- resided in or owned,
- a property with a Private Well Drinking-Water Source,
- within the area bounded in the north by University Drive, in the south by Heath Lane, in the west by Roosevelt Road and in the east by the Bay of Green Bay, all in the Town of Peshtigo, Wisconsin (depicted to the right),
- for at least one year.
